PRIVACY AGREEMENT

1. PURPOSE

The purpose of this Privacy Policy is to explain how ACS WATER SOFTWARE LLC

(hereinafter referred to as "ACS POS") collects, uses and

shares information about you through our online

interfaces. Such online interfaces include (but are not limited to) the website located at the domain https://www.acswatersoftware.com ("Website"); any

section of the Website located in a subdomain; https://www.acswatersoftware.com/ and other internal or third-party online interfaces/websites/forms found on https://www.acswatersoftware.com/ are used to collect information necessary to conduct the Company's business.

3. WHAT DO YOU AGREE TO BY USING OUR WEBSITE?

Entry into Force, Refund and Termination of the Agreement

8.1 This Agreement shall enter into force upon acceptance by the User electronically and shall remain in force unless terminated by either party as specified below.

8.2 Either party may terminate this Agreement at any time without giving any reason and without paying any compensation by giving written notice to the other party's email address one (1) week in advance. In this case, no refund of fees previously paid by the user will be made. However, the user is obliged to pay any fees that he/she has committed to pay until the end of the agreement and has not yet paid.

8.3 If the User violates the terms specified in this agreement, ACS POS may terminate the services provided to the user without prior notice and may unilaterally terminate the agreement. In this case, no refund of fees previously paid by the user will be made. 8.3 If either party fails to fully and properly fulfill its obligations arising from this Agreement, and the breach is not remedied within the given time despite written notification from the other party, this Agreement may be terminated by the party making the notification. If the breach is committed by the User, the Company shall have the right to suspend the User's status until the breach is remedied. If the User violates applicable legislation, the Company may terminate the Agreement immediately for just cause. 8.4 Termination of the Agreement shall not extinguish the rights and obligations of the Parties that have arisen up to the termination date. With the termination of the Agreement, the User shall be responsible for all fees and expenses incurred up to that date and shall not be able to use the Site and Application as of the termination date. No refunds will be given to the User in case of termination of prepaid memberships. 8.5 If the User's account remains inactive for 3 (three) months or no payment is made, the Company may terminate this Agreement. 8.6 In cases where the User account is not blocked for legal reasons and the Agreement is terminated,

The Company will provide read-only access to the content for 6 (six) months.

8.7 The Company has the right to store the content in its databases for the duration of this Agreement.

Within 6 (six) months following the termination of the User's membership period or this Agreement,

The User will be able to access the content free of charge. The Company may charge a fee for such requests submitted after the expiration of this period. The relevant fees will be specified within the Application.

8.8 Users whose services are terminated due to behavior contrary to the Company's Service Usage Agreement cannot benefit from the refund guarantee.

8.9 Software and applications provided by ACS are free of charge except for the exception in Article 4.1.

The cost arising from this exception is covered by the Refund Guarantee, providing new users with an unconditional full refund guarantee within 7 days from the date of use without giving any reason. ACS POS pays the refund amount to its user within 15 business days following the finalization of the refund process. ACS POS reserves the right not to make new sales to users who benefit from this guarantee.
